The Role Of Ethics In Ensuring Effectiveness Of Poverty Eradication And Development Schemes.

(This topic was one of the four short essays that I did for my Islamic Economics Assignment @ INCEIF for my CIFP course. It is quite brief as the lecturer had restricted the essay to a maximum of three pages. Feel free to comment. )
The Role Of Ethics In Ensuring Effectiveness Of Poverty Eradication And Development Schemes.
Ethics should not be attached to religious belief per se although every single religion advocates high ethical value. If this is correct than ethical people will only be among those who are religious. Ethics in general, encompasses moral values of a society. However, moral values changes with the development of civilization. What may be morally right before may not be so in the present day.
Ethics in Islam is a mirror of good values that is enshrined in the Shariah. It covers not only the outward acts but also includes spiritual in nature. It includes the ethics of individual, society, legal creatures (like companies, corporation, organization etc.) and most importantly the relationship between the three entities mentioned above. Islamic ethics will ensure the relationship that man has with man and most importantly man’s relationship with Allah. In other words, Islamic ethics is comprehensive and is constant over time. This is because the Shariah itself never changes but the Shariah changes those who embrace it. It is this reason why Islamic ethics is very important especially in the eradication of poverty.
To understand the importance of poverty we must understand Maqasid Shariah. Maqasid Shariah protects the five basic fundamentals of mankind’s basic needs which are:
i) Religion, ii) Life, iii) Intellect, iv) Progeny or Lineage  and v) Wealth.
The fulfillment of these needs is considered as the basic goal of Shariah. These needs are arranged according to the following three hierarchy which are:
 i) Daruriyyah (necessity); ii) Hajiyat (convenience) and iii) Kamaliyat (completeness) or Tahsiniyyat (refinements).
Poverty finds its importance in the first hierarchy i.e. Daruriyah. If someone cannot fulfill the needs of Maqasid Shariah at the Daruriyah level, he is considered to be in poverty.
Poverty has been a problem for all societies in every single civilization. It is no longer regarded as an economic phenomenon but has been accepted as social and political problem. Imam Ghazali understands poverty to be a state of not being able to fulfill one’s need. To ascertain if one is poor would depend on the concept of poverty line income. The basic requirement of one’s need differs between places and countries. Therefore, the poverty line income may change and is not static. Hence, the absolute poverty test is relative to the poverty line income. It is the government’s duty to determine the poverty line income to accurately characterize someone as being poor. Poor is further divided into needy and destitute. The destitute are those who are hard-core poor and should receive priority when attention is given to eradicate poverty. If we are able to distinguish one to fit the categories mentioned above, we can also determine who can receive zakah and who are supposed to give zakah.
Islamic ethics acknowledges the problems associated with poverty and thus made it a point to ensure an effective way to eradicate poverty in society.
The hadith where the Prophet guided a destitute man to trade his mat for some food and an axe to chop fire wood would be the basis for the eradication of poverty. An analysis of that hadith shows that it is important to guide a poor man and educate him with means to get out of poverty. Give a man a fish and he eats for the day, teach him how to fish and he will be able to eat for a lifetime is what the Chinese saying teaches us. Thus education is the most fundamental scheme.
Islam also has funding scheme which would allow the authorities to use to alleviate the poor. Namely, they are Zakah, Waqf, welfare stipend from the Baitul Mal, gifts, compulsory stipend by a wealthy family member and finding of treasure just to name a few. The rest such as spoils of war and al-Fay are no longer applicable in this era.
There is a need to create a new cycle of wealth and opportunity in order to phase out the poor from being in poverty. Currently the management of Zakah and Waqf have been extended to not only provide basic funding but to also provide scholarship for the needy and qualified students to further their education and be able to obtain decent jobs with a decent lifestyle. Successful companies also have Corporate Social Responsibility (CSR) to help create awareness to the middle and upper class society the current situation of the poor and how they can help to improve such condition. For example, “The Kids and Cash Program” by the Securities Industry Development Corporation, the training and development arm of Securities Commission, have been able to reach primary school children at the outskirts of each State in Malaysia to educate them about the importance of saving money.
There is an NGO in Malaysia called Amanah Ikhtiar Malaysia (AIM) which gives small loans with a very low service charge to hard-core poor for them to initiate small scale business. Its idea is to provide for individuals from the hard-core poor group some capital for them to earn an honest living. After educating the borrowers of their rights and responsibilities, they are placed in small groups where their business development is monitored by their peers with a need for regular updates to the AIM. The concept is similar to the hadith except that AIM provides the small loans as capital apart from assisting them in their business as well.
Even if such programs are not done by an Islamic institution per se, if its functions and objectives are to eradicate poverty and is in compliance with the Shariah, it should be accepted. This is because, as have been mentioned in the first paragraph, ethics should not be restricted to religion per se. However, as Muslims, eradication of poverty is our responsibility to do so.

Are You Always Tired?

There is this hadith that I would like to share with you.

I am sure it will help you especially if you are always feeling tired and lethargic.

It is the story about the Prophet’s daughter, Saydatina Fatima Az-Zahra (ra), the mother of Sayidina Hassan (ra) and Sayidina Hussein (ra) and the wife of Sayidina Ali Ibn Abu Talib (ra).

This hadith was narrated by Sayidina Ali Ibn Abu Talib (ra). He said:

“Once when I saw the great troubles and difficulties which Fatima Az-Zahra was going through in the household duties and also since I had been given the information that the Muslims had brought some war captives whice were taken as spoils of war, I said to Fatima Az-Zahra, “Why don’t you go to your father and ask him for a few slave-girls to help the chores around the house? Such a person will help you out and through this, some of your efforts and energies could be spread to someone else?

Saydatina Fatima went to the Prophet (SAW) complaining about the bad effect of the stone hand-mill on her hand. She heard that the Prophet (SAW) had received a few slave girls. But (when she came there) she did not find him, so she mentioned her problem to Saydatina 'Aisha (ra). When the Prophet (SAW) came, 'Aisha (ra) informed him about that. Saydina 'Ali (ra) added, "So the Prophet (SAW) came to us when we had gone to bed. We wanted to get up (on his arrival) but he said, "Stay where you are." Then he came and sat between me and her and I felt the coldness of his feet on my abdomen. He said, "Shall I direct you to something better than what you have requested? When you go to bed say 'Subhan Allah' thirty-three times, 'Alhamdulillah' thirty three times, and Allahu Akbar' thirty four times, for that is better for you than a servant."

(Saheeh Bukhari Volume 7, Book 64, Number 274)

In another narration Saydina Ali added “I have never failed to recite it ever since." Somebody asked, "Even on the night of the battle of Siffin?" He said, "No, even on the night of the battle of Siffin."

(Saheeh Bukhari Volume 7, Book 64, Number 275)

According to my spiritual teacher, this hadith is the recipe if we want to be a stronger Muslim. You can derive this from the story above. The Prophet (SAW) said that the recitation of the above tasbih is greater than having helpers to help you around the house.

I was also taught to read it after prayers.

It also helps to ward of evil if Allah wills it so. I have read that it could also cure illness. I have not been taught about how the tasbih can cure illness so I am not able to explain it further. But my heart believes that it does have a curing effect as well.

Personally, I have given it a try. I try to make it a consistent thingy but being a weak servant, I forget most of the time and only remember when I am already exhausted (a wee bit too late as sleep would be the best thing to do then)

The Tasbih itself works!

Especially if you set your mind to it, and when you recite it, ask Allah to grant you more strength so that you do not be tired and lethargic. Somehow, the more conviction that you have the better its effect. I know some will say that it is mind over matter. If you don’t mind, it doesn’t matter. But hey, at least if you still feel tired and lethargic after practicing this tasbih (although it “may” be because you do not feel that it could help you), you will still be getting reward for doing Dzikr (remembering Allah). As how Abu Hurairah (ra), who said that the Prophet (SAW) said:

Allah the Almighty said in a hadith Qudsi:

I am as My servant thinks I am.

(Another possible rendering of the Arabic is: "I am as My servant expects Me to be". The meaning is that forgiveness and acceptance of repentance by the Almighty is subject to His servant truly believing that He is forgiving and merciful. However, not to accompany such belief with right action would be to mock the Almighty)

I am with him when he makes mention of Me.

If he makes mention of Me to himself, I make mention of him to Myself; and if he makes mention of Me in an assembly, I make mention of him in an assemble better than it.

And if he draws near to Me an arm's length, I draw near to him a fathom's length. And if he comes to Me walking, I go to him at speed.

It was related by al-Buhkari (also by Muslim, at-Tirmidhi and Ibn-Majah).

How beautiful is that?

Although if you are eating some supplements, I would not suggest that you stop eating them and substitute it with this tasbih. I am no spiritual teacher nor am a physician. I am just a student learning the teachings of the Prophet (SAW) and hoping to share with you its benefits.

So here’s to a healthier life!

The Islamic Credit Card - A Misnomer?

Ahh… My exams are just around the corner. I can already see it coming closer, but the pressure to study is not really there yet. Maybe it is because I don’t have my hardworking Chinese roommate living with me at this moment. Last time, when he was my roommate in IIUM, I can safely say that he was the reason why I got better results. Stress was the feeling I had knowing that he was studying 24-7 so I decided to study as well. Peer pressure. Totally worth it!

Since my roommate is not here with me to get me to study, I have decided to post some of my revision notes in this blog. It’s not really my revision notes, but it is actually excerpts from my assignments. I use it as my revision notes.

This post is about “The Islamic Credit Cards”.

In Islam, the only loan that is allowed is Qard al-Hasan. Summarily, it means a non-interest based loan. For example, Omar borrows RM1000 from Bank Islam to be paid within 6 months. At the end of 6 months, Omar is required to pay RM1000 to Bank Islam with nothing extra. In essence, the loan is given to assist Omar in his financial difficulty and Bank Islam is not allowed to make any profit from that loan. To include an extra payment would mean that Bank Islam is using money as a trading commodity, just like what conventional banks do.

As for credit cards (also commonly referred to as plastic money), it is not actually money. A credit card is an instrument to obtain easy loan from the bank. For example, the usage of a conventional credit card begins with the Citibank issuing a credit card to Alisha. Alisha then buys a RM3000 Versace dress with her credit card. By swiping RM3000 for her dress, Alisha is actually spending someone else’s money deposited in Citibank. Versace would submit the RM3000 claim to Citibank and Citibank would pay Versace for Alisha’s RM3000 dress less a commission (around 2 – 4%) as service to Citibank. Citibank then bills Alisha for RM3000. Once Alisha pays RM3000 within the 20 days grace period allowed by Citibank, the loan transaction between Alisha and Citibank would be complete. These transactions shift around the existing quantity of money between various card holders, traders and banks but do not change the total.

Alisha’s illustration above is purely a conventional system of credit card. Assuming that Citibank has prior permission to use their depositors money for credit card loans, the above illustration is certainly Syariah compliant as it is based on Qard al-Hasan.

However, it does not stop there. In case if Alisha defaults the payment of RM3000 or if Alisha adopts to pay the minimum 5%, Citibank would than charge interest for the late payment. This makes the process not Syariah compliant anymore.

The Islamic credit cards are different. In fact, it should not even be called credit card because it is actually based on trade[1]. Maybank Islamic calls it Maybank Islamic Ikhwan Card-i. It is actually a Bay’ Al Inah transaction. In this sense, Alisha offers to buy Maybank’s asset worth RM7000 (which will be Alisha’s credit limit). Maybank agrees to sell that particular asset for RM15, 400 (inclusive of the Bank’s profit margin) to be paid on deferred payment. Alisha would then sell back the asset for RM7000 cash. It will be made available in Alisha’s Card Account and can be utilized by Alisha via the use of a card. If Alisha uses part or all of the RM7000 that she has and defaults payment, Maybank can initiate legal proceeding to claim part or all of the RM15,400.

The Securities Commission Syariah Advisory Council[2], decided to accept the opinions of the Syafie and Zahiri Mazhab where they viewed Bay’ Al-Inah as permissible (although the Syafie mazhab clearly stated that Bay’ Al-Inah is only permissible when the intention to do so is not explicitly expressed but most banks explicitly states that their Islamic credit card are based on Bay’ Al-Inah). Hence when institutions or individuals are in need of capital for a specific purpose they can utilize this method of payment, using their assets as mortgage. As they still need the assets, this method allows them to liquidate without losing the asset.

Therefore, if one is able to control their spending and is able to pay the lump sum amount that he swipes in that month, it would be better to use the conventional credit card as it is based upon Qard al-Hasan and the benefits or items that can be exchanged for the points collected is much better than the Islamic concept. If one wishes not to pay in a lump sum for the amount spent for that month, than the Islamic credit card would be the best option.

If one is not able to control their spending, one should not even get a credit card be it the conventional or the Islamic credit card.

[1] For the purpose of this paper and simplicity, the Islamic Bank’s process of supplying capital via Bay’ Al-Inah as will be explained will be referred to as “Islamic credit card”.

There you go.

I hope you learn something about Islamic Credit Card from this post.

Mayumi Itsuwa – Koibito Yo

Have you heard of her before? She’s a Japanese singer. My aunt introduced me to her music many many years ago. I use to listen to her cd in her car just enjoying her song without even knowing the meaning of it.

Today, I asked my Japanese classmate if she knew her. She said Mayumi Itsuwa is a legend. She even told me the meaning of the song I use to listen to before. Apparently it is a sad love song. A song about how a lady is pleading for her lover not to leave her all alone in the coldness of winter.

Below is the translation. The first part is quite well written. The end part is from some other website. Unfortunately, the writer of the first paragraph did not complete the whole translation.

Have a read. Listen to the song. Feel the music.

Boy am I so grateful that I have the Bride as my wife…

:)

Check out this song here.

Layan seh....

KOIBITO YO - (My dear lover)

By Mayumi Itsuwa - Japan

When leaves fall at dusk, they foretell that the cold will come soon.
On the bench rotten by the rain, no one sits to sing and whisper love.
My dear lover,

I want you to be by my side because I am feeling cold.
I want you to say with a laugh that your farewell is only a joke

A jogging man is passing through on a pebbles street

He induce me who stand still

As if he wanted me to forget,

My dear lover, now I say good-bye

The seasons rotate, though

Two of us of those days

A shooting star in that evening

Shine and disappear, heartless dream

My dear lover, please stay beside me

I want you to say with a laugh that your farewell is only a joke

Happy Anniversary To You Too!!! :)

Two years ago, about a month before my wedding date, I had to attend Biro Tatanegara (BTN). At first, I thought it was going to be very boring but boy was I mistaken! It was really enjoyable. Anyhow, this post is about one of the funny incident that happened during BTN.

It was an activity to get to know all of the participants. What the facilitator did was to narrow down some facts and if those facts are relevant to anyone of us, we had to move forward.

I can’t really remember what the beginning facts were but I remember something about the month of April. I think the facilitator asked if anyone was having anything important event in April.

My friend Daud and I stepped forward.

We looked at each other and smiled. We knew that we were both going to get married on the SAME DAY in April!

Then the facilitator asked us to inform of the day of the important event. We both said 4th of April. At this time, we were the only two upfront, standing side by side.

Then the facilitator asked me, what my special occasion on 4th of April was. I said I was going to get married on that day. Everybody clapped.

Now everyone was looking at my friend who was just standing beside me.

Kamu ada apa pulak 4 April 2008 nanti?

Saya pun nak kahwin 4 April 2008…… Tapi bukan dengan dia lah…

(he said calmly while pointing his finger to me)

The whole hall started to laugh!

The Facilitator then concluded:

Nasib baik lah!

Hahaha

Coincidentally, his wife is also my virtual blog friend. This is her link. If you want some unique quotes, you can get it from her blog posts. It amazes me how she manages to find all this quotes. (mungkin dia ada buku quotes kot… hmmm)

I would like to take this opportunity to say:

Happy Anniversary to the both of you! May Allah bless you both with eternal love and great success!

Good luck with that bundle of joy!

B.E.S.T. dapat anak! :)

2nd Year Anniversary

Two years ago, on this day, I shook hand with the local Imam for the Bride’s hand in marriage.

Today, Alhamdulillah, we celebrate our second year anniversary with Alisha Alhabshi.

After getting some help from my cousin and his sister-in-law (big thanks Azmi and Lana!!!) I made some enquiry to the RedRibbon with some specific requests. RedRibbon is the pioneer and Malaysia’s leading online supplier of unique gifts. All I had to do was to send them an email saying requesting for their help for a relaxing couple spa with a Jacuzzi in the same room. (Hehe, kalau separate Jacuzzi boringla!) Within one day I received a reply with two options that were well within my budget and complied all that I had earlier requested.

I took one of the offers and paid. It was the “Velvet Indulgence Couple Spa” at the Jojoba Spa at Berjaya Times Square Hotel. I have never been there before but since it was recommended by RedRibbon, I thought it can’t be that bad.

The Bride knew nothing about this but I did told her that I’m planning something for “us”. She kept on trying to get me to spill the beans and inform her what was my surprise.

Of course I did not give in and lose the satisfaction of torturing her sweet little curiosity! I told her that I had some plans for her on Sunday morning so that she could book her parents to babysit Alisha. I told her we would be away for a few good hours and would only be back after lunch.

Other than that, I kept feeding her with all sorts of nonsense like how we would need to walk for about 2km so she needs loose clothes and comfy shoes. That actually I planned for some golf classes so that we could spend some quality time golfing. That actually it was not golf lessons but a mini golf game. No, actually it was not mini golf but maxi golf. That we could opt for bowling or archery if she was not keen on golfing. That the place is something like Club Med but since its in KL, it’s called Club Crazy.

Last night, as I was also rolling on the bed, I told her that she should at least give golf a try and not brush it aside as boring even before we played it although I know for a fact that she has never liked golf.

I’m quite sure she didn’t know whether to believe me or not for the whole time.

So off we went out on our surprise little date this morning. As we reached Berjaya Time Square, the Bride thought that I was taking her to the indoor theme park. I just smiled and walked with her to the hotel and up to the 15th floor. At JoJoBa’s entrance, I told her that I’m meeting a friend there for something but that didn’t work anymore. Someone was too excited to even care if it was just another bullshit. :)

*The couple room*

*Feeling great after the 2hour Spa*

*The romantic togeder-geder Jacuzzi*

*Ek ehem... Kasut baru*
After the whole thing, we had steamboat lunch at Johnny’s and came back home feeling full, pampered and looking radiant!

B.E.S.T.
HAPPY ANNIVERSARY LOVE!

"Consent" Is The Difference...

Today in class there were some discussions about Hudud Law. Some say that in order for the country to be free from crime, it must implement Hudud Law as a deterrent preventive measure. Apart from just implementing Hudud Law as part of a country’s criminal law, some of my classmates also thought that education regarding Hudud Law should be introduced even from primary level.

Yes. I would agree to these ideas.

However, there were some quarters who opposed to the implementation of Hudud Law. One of the many reasons is focused on rape cases. Apparently, what they understand about rape cases under Hudud Law is that when a rape victim alleges that she was raped, she (the rape victim) will need to bring four witnesses to prove that she was raped (as in adultery / Zina cases). Due to the lack of four witnesses witnessing the act of rape, the rape victim would not be able to prove she was raped as required under Hudud Law and the rapist would be able to get away unpunished.

The above paragraph seems to be a rational way to attack Hudud Law. If it carries any truth in it, I would certainly agree that Hudud Law should not be implemented as it would bring injustice to rape victims.

Fortunately, the above reasoning against Hudud Law is perversely wrong. The reason is this. In Islam, “Adultery” and “Rape” are two different sexual offences. Its most significant difference is the concept of “consent” in both offences. In “Adultery”, both parties must consent to the sexual act between them. However, there can never be consent in “Rape”. As there is no “consent” in “Rape”, therefore we cannot use the requirements in proving “Adultery” for “Rape” cases.

As far as I am concern, the closest Hudud Law that could be related to “Rape” is probably in “Hirabah” / “Robbery”. Well, to me, raping a girl from her modesty and purity is an act of robbery against her. You do not need four witnesses to prove robbery as two witnesses would suffice. Alternatively, if you cannot get two witnesses, circumstantial evidence (like DNA samples etc) could be used to prove the act of rape and would be sufficient to sustain a “Robbery” charge under Hudud Law. Worst case scenario, if the “Robbery” threshold is not met under Hudud Law, the offence would automatically fall under “Ta’zir” (which could also be defined as “Judicial Discretion”) and is similar to our current Penal Code threshold for “Rape”.

The crucial part if the Prosecution manages to prove the rapist’s guilt under “Robbery” within the Hudud Law threshold, is that the maximum punishment for “Robbery” under Hudud Law is death.

Wouldn’t that be a deterrent punishment for rape?

It would certainly make the rapist think twice before he accommodates his lust and attack his victim.
