There are so many things that Muslims do in their daily activity which relates to Isra' Mi'raj. Let's just look at some of the things here.</p>
<p dir="ltr">It was the night the Prophet SAW went to Masjid Al-Aqsa and was then ascended to the highest Heaven to meet the Most Gracious and the Most Merciful. </p>
<p dir="ltr">The Tahiyyat recitation that we read was the beginning of the conversation between Allah SWT and the Prophet SAW. Such an important historical event and yet we recite it during tahiyyat as though it was just another simple zikr which doesn't evwn move our heart.</p>
<p dir="ltr">There, he recieved the direct command to perform the 50 obligatory prayers in a day. As he was descending back to earth, Prophet Moses AS met him and adviced him that 50 is too much for his ummah to comply. Prophet Moses AS asked him to gonand get a further discount or reduction on the number of obligatory prayers. The Prophet SAW went up again and got the discount but as he passed by Prophet Moses AS, again he was requested to seek further reduction. The Prophet SAW obliged and went back up again. This process was repeated until the number of prayers was reduced to 5 times a day.</p>
<p dir="ltr">Thus we have the 5 daily prayers command given directly to the Prophet SAW as a sign of mercy to us. </p>
<p dir="ltr">It was also the night the Prophet rode the Buraq, an animal which travels at super speed. The transport that was used by Prophet Abraham AS.</p>
<p dir="ltr">When the Prophet SAW told the people about Isra' Mi'raj the next day, the first person to believe him was S. Abu Bakr RA when he said, "I hear and I believe". No questions was asked because his heart is filled with Iman to the Prophet SAW. Whatever the Prophet SAW said is the truth even if his cognitive mind cannot make any logical explanation of the command. Hence he was called As-Siddiq. As-Siddiq means "Given to always telling the truth" or "the one who affirms the truth".</p>
<p dir="ltr">There are many other hadith which tells us the kinds of punishment the Prophet SAW saw as he was descending up to the highest heavens, the Prophets that he met at the gates of Heaven etc. I encourage you to go and read about these historical stories to boost your Iman. </p>

Firstly, you must be able to distinguish between Hudud Laws and implementing Hudud Laws. I said this in my previous post, people must realise the difference between Islam and Muslims. The former is perfect while the latter isn't. So don't blame the perfect Islam because of the imperfect Muslims. Secondly, you must know the difference between the acts punishable under the Hudud and don’t get mixed up. Zina has nothing to do with rape. Theft is different from robbery.<br /><br />The Shariah is meant to keep people feel safe and secure in your homes or on the streets. It jealously protects the Maqasid Shariah. Hence the punishments which relates to the deprivation of these fundamental breaches of Shariah are very severe and radical and it must be across the board. This is especially so if the act involves the Sultans and Ministers as well as their wives and their kids. Even the Prophet SAW said that he would cut his own beloved daughter’s hand if she was found committing theft.<br /><br />Take theft for example. The idea of theft stems from the rules governing property in Islam. The act of stealing means it is done in stealth, in an area that is known to be protected and the subject matter is an expensive item. What this means is that the security of the owner’s property was jeopardized and the thief didn't even allow the owner a chance to defend his rights. That's the worst depravity.<br /><br />Hudud works in a paradox. Analogy. There is another analogy which is better in distinguishing between Islamic
finance and conventional finance. To start, let me explain briefly the Halal

whereby the halal animal is slaughtered in accordance to the Shariah and its
meat is permissible to be eaten as compared. Conventional finance on the other
hand is the haram meat where the animal is sourced illegitimately and it is not
slaughtered according to the Shariah making it not permissible, under the
Shariah, to be eaten. <o:p></o:p></span></span></div>

<span style="line-height: 150%;"><span style="font-family: Arial, Helvetica, sans-serif;">The fact is that both meat, if eaten, would give the same physical
outcome (feeling satiated) however, the Shariah only permits one to eat the
halal meat and not the haram meat.<o:p></o:p></span></span></div>

<span style="line-height: 150%;"><span style="font-family: Arial, Helvetica, sans-serif;">In other words, if you opt for an Islamic house financing, the
monthly instalment that you pay is Shariah compliant as compared to a conventional
house financing based on riba’ which is not Shariah compliant. The outcome of
both financing are somewhat similar, pay your instalment and you will own a
house at the end of the tenure.<o:p></o:p></span></span></div>

1, the child is a bastard child. In example 2, the child is a legitimate child.
The process that the guy and the girl did to get the child is the same i.e.
they had sex. The outcome of that sexual intercourse is that they got a child. <o:p></o:p></span></span></div>

<span style="line-height: 150%; mso-bidi-font-size: 12.0pt;"><span style="font-family: Arial, Helvetica, sans-serif;">The
only difference between example 1 and example 2 is that the guy and the girl
were validly married in example 2. They had a contract / aqad between them that
the Shariah recognises, and out of which, the child is recognised as a
legitimate child. The Shariah did not recognise the mutual consent to have sex
in example 1. As a result, the child is a bastard child.<o:p></o:p></span></span></div>

<span style="line-height: 150%; mso-bidi-font-size: 12.0pt;"><span style="font-family: Arial, Helvetica, sans-serif;">Both
children in example 1 and 2 are somewhat similar, just like the end result in
both Islamic finance and conventional finance.<o:p></o:p></span></span></div>

other words, the Shariah compliant contract in Islamic finance is the crux that

is one of the many reason why in Surah Baqarah, Allah states clearly that He
has permitted trade and forbidden Riba’. Trading, based on principles approved
by the Shariah will result in profits that is recognised by the Shariah to be
legitimate income (just like the child in example 2). Riba’ however, will
result in illegitimate gains that is NOT recognised by the Shariah (just like
the child in example 1).<o:p></o:p></span></span></div>

Clients can be really demanding as well... and stingy. Hehe. But that's besides the point. </p> <p dir="ltr">Coming back to my point of absorbing liabilities. Banks for example, prior to the diabursement of the loan or finance, would require a legal firm to give an undertaking that everything in relation to the loan or finance is in proper order and is valid and enforceable. This is a common practice in all banks in prior to drawdown if an external solicitor is engaged. It is the bank's way of minimising their risk by shifting the requirement to ensure the validity and enforceability to the legal firm.</p> <p dir="ltr">The idea of shouldering this risk is what I did not enjoy because I think too much. And I would not stop thinking about many different angles of a particular matter to ensure that I have covered all angles. Its really tiring and exhausting. Before you sleep you suddenly remember whether your staff had filed your form34 on time or when the LHDN is going to give their valuation as the expiry date on the MOT is almost expiring... and you have not asked your client for the transfer fee because your client wants the exact figure. </p> <p dir="ltr">So when I joined this new place, I honestly felt the heavy weight on my poor shoulders lifted almost immediately. It was amazing how that invisible weight could really affect my character and personality. </p> <p dir="ltr">I was sharing this with the Bride and she confirmed that I looked more cheerful and jovial the moment I left legal practice. Haha.</p> <p dir="ltr">Be that as it may, u actually learn a lot in private practice if you have really good mentors. I learned a lot from my boss. Last week, the. Bride and I went for her now weekly check-up. To be honest, I wasn't quite keen to go for this check-up as we had just been to the hospital a few days back for a false alarm check-up but the Doc-who-whispers was not there, only the mid-wife. The scheduled check-up was with the Doc-who-whispers.

The concept of becoming a Muslim is simple. It is to do the five pillars of Islam. These five pillars are:<br />

1. The proclamation in one's heart and tongue of the "Two Witness Statement" or the "Shahadatain". The first is to proclaim that "There is no God but Allah" and the second is to proclaim that "Prophet Muhammad (peace be upon him /pbuh) is His messenger". In a nutshell, it means to believe in the Oneness of Allah by not associating Him with any other, and to believe that the Prophet Muhammad pbuh is His final Messenger and to accept all of his Islamic teachings and message;<br />
<br />
2. To pray the five compulsory daily prayers which is the Fajr, Zuhr, Asr, Maghrib and Isya';<br />
<br />
3. To fast in the month of Ramadhan;<br />
<br />
4. To pay Zakat from the excess of one's wealth once it fulfils the minimum amount and have been kept for a whole year; and<br />
<br />
5. To perform the Pilgrimage in Mekah.<br />

For this post, I plan to just touch a bit on the first pillar of Islam, the Shahadatain.<br />
<br />
The Shahadatain looks fairly simple but I essence, it is the crux of being a Muslim. The proclamation of the Shahadatain will lead you to the 6 pillars of being a Mu'min, which means being a believer. The 6 pillars of faith are:<br />
<br />
1. To believe in Allah, as the one and only God;<br />
<br />
2. To believe in the existence of the Angels;<br />
<br />
3. To believe in the Divine books that has been revealed to mankind, that of which only the Quran remains to be pure and true to all of its very letters;<br />
<br />
4. To believe in the Prophets that has been sent to mankind;<br />
<br />
5. To believe in the Day of Judgment; and<br />
<br />
6. To believe in the Qada' (Divine Will) and Qadar (Divine Decree) of Allah.<br />
<br />
Heavy? Of course it is. This is religion, not Sesame Street cartoon. And yet, people take it very lightly.<br />
<br />
Apart from that, the Shahadatain must not be proclaimed under duress as Allah forbids the entering of Islam due to force.<br />
<br />
If a Muslim hears a person uttering the Shahadatain, it is not up to him to determine if that man is sincere or is just saying to deceive others. The sincerity of the Shahadatain will be judged be Allah, the God who knows what is hidden and apparent, including what is in the heart and the mind.<br />
<br />
Between a Muslim and Allah, his Creator, the Shahadatain is the irrevocable consent that he gives to Allah which confirms that he will abide by whatever Islamic teachings that has been taught by Prophet Muhammad pbuh.<br />
<br />
The Shahadatain will be the reason why a Muslim will perform goodness and stay away from evil as defined in the Quran and Sunnah. It is the Shahadatain that makes a Muslim to avoid the prohibited acts such as consuming alcohol, adultery, injustice, interest etc.<br />
<br />
It is the Shahadatain that binds a Muslim to cover their modesty (awrah) and live by the rules of the Shariah (Islamic Law) such as Hudud, Qisas and Ta'zir.<br />
<br />
The fact that we lack the capacity to perform all that has been made compulsory to us and to avoid all that has been forbidden to us does not mean that it is okay, even if the majority of the people are not abiding the Shariah.<br />
<br />
To be denial that the Shariah is not made compulsory upon us is an act of disobedience to Allah which in fact is the very reason why Iblis is cursed by Allah.<br />
<br />
The idea is to accept our weakness and strive to be a better Muslim. Make dua that Allah grants us the strength to fulfil our Shariah obligation.<br />
<br />
And remember to latch yourself to the idea of Allah will forgive you for your sin and that He will have mercy on you because He is Most Forgiving and Most Merciful.<br />
<br />
And also remember to seek for His forgiveness and His Mercy. What's the point of knowing that He will forgive but not asking for it right?<br />

You appear as a burden to those who failed to value you for what you are worth. <br />
In fact, you are deemed worthless by those who do not welcome you. <br />
At times, you are so easy to be perfomed but yet, at times you come with so many distraction, obstacles and hurdles that requires extreme effort. <br />
Even though your Creator ranked you as a supplemantary deed, you were indeed the highlight of the month. You were not prescribed upon men but performing you is an act of distinction. <br />
Your very nature creates disagreement between men but you know yourself that those who calculate you in would not benefit them at all. <br />
Sometimes when we are together in your Creator's house, men seems to want to share with the rest what he had enjoyed by releasing digested odor that happily fills our nostril. <br />
You adorn yourself with the words of Your creator and praises to Him. You fill the gap between yourselves with Salam to the final Messenger SAW. <br />
But now you bid us farewell as you go rest for a whole year. <br />
For as long as the Hour has not arrived, your punctual attendance is confirmed. <br />
Those who regard you as an acquaintance will not miss you too much. <br />
Those who are in love with you will enjoy you when you are here and be worried if they would be able to meet you again next year. <br />
Indeed, you, are a sign of Mercy from the Lord of the Universe. <br />
You have touched so many lives and you have witnessed the Night of Power led by the most beloved Angel. <br />
May you be a witness to us on the Day when everything will be revealed. <br />
May you stand by us as how we stood performing you. <br />
May you lift us up as how we raised over and over again performing you. <br />
May you testify for us as how we testified your existence. <br />
May you be a reason for our victory on the Day where we are at the Mercy of the Most Merciful. <br />
May you cloak us as how we forbid all that is allowed to us to fulfill your existence from the time we raise our hands and say "God is the Greatest" till we bid "Salam" to the recording Angels who misses nothing except when the Most Forgiving instructs them to ignore our sins because He has forgiven us. <br />
May you make us be better after you have trained us to perform you. <br />
May the One who has in control of all souls grant us the privillege to meet you again. <br />
May you remember us as how we will be missing you. <br />
All praises and Glory be to the Most Merciful for having created you. <br />
O Terawih, the heart saddens as the final "Salam" is uttered as a goodbye to you. <br />
The eyes leak knowing that we had not siezed the opportunity to enjoy you as how you are worthy of being performed. <br />
Certainty dictates that you leave us but uncertainty taints if we would ever meet again. <br />
O Allah, forgive us if we have failed to embrace this creature of yours as how we should have. <br />
Verily, You, O Allah, are most Forgiving and You love to forgive so forgive us. <br />
And forgive our parents, our household, our teachers, our fellow Muslims and Mu'mins. <br />
And note our bid of Peace and Salam to Your Messenger SAW. <br />

May Allah make it easy for you to fast, pray Terawih and read the Quran this Ramadhan. One Sheikh said, Ramadhan should not just be about fasting only. That's expected as its obligatory upon a Muslim the moment we said the two Shahadah. Ramadhan is about the night prayer and Quran. We must increase our prayer and reading the Quran during Ramadhan. So hopefully we could all live long enough to complete this Ramadhan and completely with great success Insha Allah :) <br />
I'm BACK!<br />
I am so sorry for the super long hiaitus. Couldn't help it. My new work has been taking away too much of my positive vibe as it kept on challenging me on new and fresh matters which required me to really research and read up. I never liked not knowing how to do my work and this pressured me to study even more. Not being on top of things really sucks and it just takes away my mood to blog. <br />
Penat... But with God's willing, this super steep learning curve is going to be worthwhile. <br />
I used to go back late while trying to 'finish my work'. By the time I get back home, the Bride would have already been asleep and although lil Chempedak would be awake, it is too late to play with her. So the Bride and I discussed and concluded that we would carpool everyday. This way, I would have to go back early and I get to spend more time with the Bride and Chempedak. <br />
Since I know that I have to leave early, work productivity after lunch has increased as I have to complete some work before going back and if the work is going to take a long time, I'd put it aside for it to be done at home that night and complete other matters first. I guess when you know the time limit to finish work, you tend to organize your work better. So far its working for me Alhamdulillah. <br />
And a colleague of mine just resigned. So naturally, I inherited his files. That occupied most of my time at the office. <br />
But things are getting better now. It has almost been a year now that I'm at this Firm. With experiance increasing rapidly now, I'm more comfortable doing what I do now. But there's just so much more to learn. <br />
A friend of mine from YMP told me yesterday the way to know if we made the right choice is if we end up being closer to Allah. I guess I can say that it seems to be the right choice for me as I have been praying even harder now for Allah to help/assist/guide me with my new work. So Alhamdulillah. <br />
So that's the brief update about the long silence. <br />
Will find more time to write more especially this Ramadhan insha Allah. <br />

My dad told me that my late maternal grandfather (his father
in-law) (may Allah have mercy on him) told him that man will love his children
more than he loves his own parents. The reason being that our personality trait
all comes from Prophet Adam AS and Prophet Adam AS did not have parents to show
his love upwards. He had children and he loved his children. <o:p></o:p></div>

I googled this and found the same explained in a Torah

haKadosh explains that the nature is that fathers love sons and fathers love
daughters. However, it is also nature that the parental love to their children

The Shalo"h haKadosh explains that every personality trait that exists in
creation is inherited from Adam. However, Adam had no parents. Therefore, Adam
never exhibited the emotion of loving his parents. He did, however, develop an
emotional love for his children. Hence, this love transferred down to all his
descendants -– even though they did have parents -– their love of children was
greater than their love of parents. The Shalo"h haKadosh concludes by
citing the whimsical quip that one father lovingly provides for 10 children but
10 children cannot support one father</i>.</div>

Kind of make you feel that love is like gravity. It flows down easily but you need a pump to make it go upwards. That pump is effort. Maybe this is also the reason why we are hugely rewarded when we please our parents especially when they are old and sensitive. <o:p></o:p></div>

I got the Bride a Russel Peter's ticket as her Mother's Day gift. It was one of the funniest gift I have ever given to her. We nearly fell off our chair laughing at one of the funniest Indian man. The Bride nampak macam sampai keluar air mata gelak.
Last week it was her Birthday. Manage to get her a nice handbag and a brand new Ipad2 (which Alisha dah dengan selamber claim ownership). Oh well Mommy, at least you get your phone back again hehe. this is my first post using the ipad. Still new and kekok.
Hik hik hik, did your read carefully who's name was in between Alisha and I? Yup, you read it right...Dot2...
We just found out that Alisha nak dapat adik... But somehow, for this Dot2, the Bride didnt feel the urge to share the news. I have been waiting for her to write something about it but i don't think its coming anytime soon so I'm just gonna share it here hehe.
We found out about Dot2 after we came back from Umrah sometime in March. Dot2 actually was in existence when we did our 4 Umrahs. All praises be to Him who gives life from nothing.
Alisha is excited too. Now she can be like her favourite cousin and idol, Kak Wa. So sometimes, she has started to refer to herself as Kak Icha. Her scool has been very supportive too. Their starting to teach the kids about the coolness of being an elder sister or brother. An awesome step to some mental preperation.
The Bride has started a new business. Its called BabyHoots. Its the best place for you to get a baby basket for your friends or relatives. I tell you, life has never been so easy for me ever since she started this project. The moment someone I know pops a baby, all i need is a simple email or whatsapp to my friends, collect some contribution (an ideal gift would be around 150-300 and the Bride would get the stuff ready within the same day. Delivery is not an issue as i personally know where she stays :) Jokes aside, its really an awesome service to mankind. Haha. You can get Guess shoes, Next clothes, Carter's rompers, Timberland bips, baju sup bonjot (it the kind of baby clothing with which is like a jubah but with some strings at the bottom that can be tied. Wow, this blog has been idle for so long. So sorry about that. Am trying to cope with the workload at the my firm. So far Alhamdulillah semenjak balik Umrah, tak da time nak duduk chillex kat office. So much stuff to learn now that im doing full time corporate work. The areas of practice is so wide i feel like so loss. Hopefully i am able to grasp the transition soon. SUSAH WEI!!! Hahaha. But Alhamdulillah, i have a good team and awesome coleagues who do not give me a headache but are so super patient when I give them a headache. Serius kadang-kadang rasa macam, "amenda aku belajar kat law school kalau satu benda pun aku blurr". Hahaha.

If I don’t have any work, my blogging mind goes into slumber.</div><div align="center" class="MsoNormal" style="text-align: center;">The reason why you are reading this update is because I have to review two totally different matters over the weekend. Haha.</div><div align="center" class="MsoNormal" style="text-align: center;">Anyway, I wanted to write one small matter relating to husband and wife relationship.</div><div align="center" class="MsoNormal" style="text-align: center;">The best idea that each spouse should have is to please their spouse more than they please themselves. In other words, pleasing your spouse should be a priority over your own satisfaction. But that does not mean that you should not be happy yourself. If both spouse have this mentality, you would not be worried about not being happy because you would know that your happiness is the priority of your loved one as how her happiness is yours.</div><div align="center" class="MsoNormal" style="text-align: center;">Having a relationship based on this mentality is not only healthy but it also eliminates negative presumptions.</div><div align="center" class="MsoNormal" style="text-align: center;">Let me give you an example.</div><div align="center" class="MsoNormal" style="text-align: center;">One day, the husband had to stay back in his office until super duper late. He did not have the opportunity to have dinner. His wife on the other hand, was super duper busy the whole day and was dead tired that night so she went to bed early. When the husband returned home, he still had homework to do but he needed something to eat and drink. Considering that his wife was already asleep, he didn’t want to wake her up to re-heat the food but he was in dire need for coffee specially brewed by his wife in order to be awake to finish his work. He politely wakes her up for that coffee.</div><div align="center" class="MsoNormal" style="text-align: center;">Yeah, you might be thinking that that husband is super selfish when he can make his own coffee but let’s say that this couple had a thing where only the wife will make coffee and the husband does the dishes. LoL!</div><div align="center" class="MsoNormal" style="text-align: center;">Anyway, if the relationship is not based on the earlier premise I have set out, the wife would get up and show a tantrum to the husband for waking her up to make a stupid coffee, make that coffee, pass a snide remark to the husband and goes back to sleep. The husband would be left with a cup of coffee, homework and also an angry feeling that his wife didn’t understand the fact that he was hungry and tired and that he didn’t even asked for food but just a simple cup of coffee. With such attitude, he might as well ask for food for at least he could be angry with a full tummy.</div><div align="center" class="MsoNormal" style="text-align: center;">But if that relationship is based on the premise I mentioned above, the wife would get up and instinctively realise that her husband would not wake her up for merely a cup of coffee because he could have done it himself and that her husband must hungry after a long day and night of working and still having some homework. She gets up, wanting to please the husband, make coffee, reheat some food, add a little back massage and sits down to listen to the husband’s plea for sympathy as he gobbles up a really late dinner, and then goes back to sleep.</div><div align="center" class="MsoNormal" style="text-align: center;">The satisfied husband then continues to do work and is happy that his wife understands his needs without even having to ask for it literally. When he gets his salary or bonus, buys his wife a nice gift just because he too wants her to be happy.</div><div align="center" class="MsoNormal" style="text-align: center;">For you see, sometimes, it is nice to get something that we want without having to ask for it.</div><div align="center" class="MsoNormal" style="text-align: center;">But since none of us are mind readers, we have to create a conducive environment and a healthy relationship so that by merely hinting a small thing, we can get what we actually want. Allah Apostle replied: " Allah (the) One, the Self-Sufficient Master Whom all creatures need.' </div><div align="center" class="MsoNormal" style="tab-stops: 103.0pt; text-align: center;"><span style="font-family: Arial;">For starters, in other chapters of the Quran, the name of the Surah is given because that word (which represents the name) is mentioned somewhere in the Surah. For example, the word Baqarah is mentioned in Surah Al-Baqarah. (Although Fatihah is not found in Surah Al-Fatihah but since Fatihah means the Opening and considering that Surah Al-Fatihah is the first chapter of the Quran, it is easy to apprehend why that surah is called the Opening.) But this is not the case for Surah Al-Ikhlas. Being the 112 chapter, with only 4 verses, there is no mention of the word Ikhlas in Surah Al-Ikhlas.<o:p></o:p></span></div><div align="center" class="MsoNormal" style="tab-stops: 103.0pt; text-align: center;"><br />

First it says that there is only one God. Then, it says that we are all dependent on this one God because He is Everlasting and Absolute when we are all nothing as compared to Him. It means He who is independent of others and others are dependent on Him. Faultless. Thereafter, it says Allah did not originate from anything and neither is He subservient to another God. This third verse indicates the Oneness of Allah where there is none before Him or after Him. It is because if you don’t sin, you are on spot on. You target and goal is clear and you can reach it. Notice that the word sin is never used in television anymore? And then you get bored of repenting and you start to thank Allah for all the blessings that you have been enjoying from Him. This goes on for another couple of months.<o:p></o:p></span></span></div><div align="center" class="MsoNormal" style="line-height: 150%; text-align: center;"><span style="font-family: "Arial","sans-serif"; font-size: 12.0pt; line-height: 150%;"><span style="color: blue;">Then you start to think and feel as though you are in the safe zone under Allah's full protection that you get lazy to wake up in the middle of the night to thank Him. Slowly you start to drift away from Him and WHAM!!! You start sinning the same old shit all over again.<o:p></o:p></span></span></div><div align="center" class="MsoNormal" style="line-height: 150%; text-align: center;"><span style="font-family: "Arial","sans-serif"; font-size: 12.0pt; line-height: 150%;"><span style="color: blue;">You missed your mark again. <o:p></o:p></span></span></div><div align="center" class="MsoNormal" style="line-height: 150%; text-align: center;"><span style="font-family: "Arial","sans-serif"; font-size: 12.0pt; line-height: 150%;"><span style="color: blue;">And if you are lucky to still be alive and have the opportunity, you repent and the cycle goes on.<o:p></o:p></span></span></div><div align="center" class="MsoNormal" style="line-height: 150%; text-align: center;"><span style="font-family: "Arial","sans-serif"; font-size: 12.0pt; line-height: 150%;"><span style="color: blue;">If you are unlucky, you start to feel as though you are just cheating God and that your repentance is not sincere because you keep sinning the same sin again. How could your repentance be accepted if you do the same thing again?<o:p></o:p></span></span></div><div align="center" class="MsoNormal" style="line-height: 150%; text-align: center;"><span style="font-family: "Arial","sans-serif"; font-size: 12.0pt; line-height: 150%;"><span style="color: blue;">Be careful my friend. Iblis has this manipulative way of pulling you astray from the straight path. He’s been doing it from Prophet Adam AS’s time and he ain’t gonna stop till its the end of the world (read <a href="http://adamalhabshi.blogspot.com/2008/09/foolish-intellect-article-version.html">here</a> and <a href="http://adamalhabshi.blogspot.com/2010/09/difference-between-adam-as-and-iblis.html">here</a>.) Then when the Day of Judgment comes and we all blame him for our sin, he would say, “</span><span style="color: purple;">No no no, I just whispered. You were the one who did that sin. Because your repentance is for a past action. In a rape case, one party does not consent to the sexual intercourse. Hence some ulama categorise rape as a form of robbery to one’s dignity. Under Hudud Laws, in a case of robbery, the ultimate punishment is death or crucifying the convict and to leave the body in a public place as a show to others how the Shariah detest robbery.<o:p></o:p></span></div><div align="center" class="MsoNormal" style="text-align: center;"><span lang="EN-MY" style="color: #1f497d; mso-themecolor: text2;">Now, this is my understanding on the Hadd for Zina. (Hadd is the singular term for Hudud. When we say Hudud, it includes all of the Hudud offences. When we say Hadd, we are referring to only one of Hudud offence).<o:p></o:p></span></div><div align="center" class="MsoNormal" style="text-align: center;"><span lang="EN-MY" style="color: #1f497d; mso-themecolor: text2;">Please correct me if you think I am wrong as I stand to be corrected.<o:p></o:p></span></div><div align="center" class="MsoNormal" style="text-align: center;"><span lang="EN-MY" style="color: #1f497d; mso-themecolor: text2;">My analysis on Hadd for Zina is based on my formal tertiary education as well as my reading and understanding of the Shariah.<o:p></o:p></span></div><div align="center" class="MsoNormal" style="text-align: center;"><span lang="EN-MY" style="color: #1f497d; mso-themecolor: text2;">Mainly, Zina is a crime because it tarnishes one's honour and lineage, two of the factors which the Mawasid Shariah (Objectives of the Shariah) protects.</span></div><div align="center" class="MsoNormal" style="text-align: center;"><span lang="EN-MY" style="color: #1f497d; mso-themecolor: text2;">The Hadd punishment for Zina is divided into two. The flogging of 100 times at the back is for an adulterer who is not married and the stoning to death for an adulterer who is already married. </span></div><div align="center" class="MsoNormal" style="text-align: center;"><span class="Apple-style-span" style="color: #1f497d;">“Sula” or the act of shoving a sharp pole from the anus until it comes out through the mouth was a customary punishment given to adulterer in the olden days in Malaya. Sula is not a Shariah punishment and definitely not a Hadd punishment.</span></div><div align="center" class="MsoNormal" style="text-align: center;"><span lang="EN-MY" style="color: #1f497d; mso-themecolor: text2;">Hadd for Zina is only for Muslims. Although adultery is heinous crime and detested in all religion, only some religion actually imposes heavy punishment for adultery. Islam is one of the religion.<o:p></o:p></span></div><div align="center" class="MsoNormal" style="text-align: center;"><span lang="EN-MY" style="color: #1f497d; mso-themecolor: text2;">In other words, under the Shariah, sexual intercourse out of wedlock for a married Muslim is a death penalty. If only this was stressed during pre-marriage courses, we might get fewer affairs in marriages.<o:p></o:p></span></div><div class="separator" style="clear: both; text-align: center;"></div><div align="center" class="MsoNormal" style="text-align: center;"><span lang="EN-MY" style="color: #1f497d; mso-themecolor: text2;"><o:p> </o:p></span><span class="Apple-style-span" style="color: #1f497d;">Okay, that’s the Hadd punishment for Zina.</span></div><div align="center" class="MsoNormal" style="text-align: center;"><span lang="EN-MY" style="color: #1f497d; mso-themecolor: text2;">But before we can punish somebody, we need to convict / prove that he is guilty of the offence.<o:p></o:p></span></div><div align="center" class="MsoNormal" style="text-align: center;"><span lang="EN-MY" style="color: #1f497d; mso-themecolor: text2;">There are only two ways to convict an adulterer under zina and punishing them with Hudud. The first is via sincere confession(s) and the second is if the fornicating act is witnessed by four male witnesses.<o:p></o:p></span></div><div align="center" class="MsoNormal" style="text-align: center;"><span lang="EN-MY" style="color: #1f497d; mso-themecolor: text2;">As for the first category i.e. via sincere confession (s), I included the (s) to indicate a plural form of confession because some jurist have even required the confession be made four times and done at different times - to make it equivalent to 4 witnesses. The retraction of one admission out of the four times will annul the Hadd for Zina as it is like only having 3 witnesses instead of 4.<o:p></o:p></span></div><div align="center" class="MsoNormal" style="text-align: center;"><span lang="EN-MY" style="color: #1f497d; mso-themecolor: text2;">As for the second category, the fornicating act MUST be witnessed by 4 male witnesses. Jurist have explained that these four male witnesses must SEE the penis entering and exiting the vagina a few times and are super damn sure that the sexual intercourse really did happened. The level is beyond reasonable doubt as any traces of doubt would destroy the certainty in imposing Hadd punishment. The moral behaviour of each of the four male witnesses must also be of tip top character and can be challenged. Some jurists have debated the acceptance of female witnesses. That could be another point of law as well.<o:p></o:p></span></div><div align="center" class="MsoNormal" style="text-align: center;"><span lang="EN-MY" style="color: #1f497d; mso-themecolor: text2;">In my mind, the only way for the second category to happen is if the couple were fornicating in PUBLIC. Some may say that if an unmarried Muslim couple living together and have kids, this could be a good case for Hadd punishment. I beg to differ.<o:p></o:p></span></div><div align="center" class="MsoNormal" style="text-align: center;"><span lang="EN-MY" style="color: #1f497d; mso-themecolor: text2;">I have some reservations here. DNA test may be accurate do determine paternity of the child but that should not be the benchmark to prove Hadd punishment as there are no 4 male witnesses who saw the intercourse. Using DNA is to establish an evidence after the act of intercourse when Hadd punishment is for the act of intercourse. Hadd punishment is not to eliminate all traces of adultery. Ta’zir punishment could be used as an alternative punishment but not Hadd.<o:p></o:p></span></div><div align="center" class="MsoNormal" style="text-align: center;"><br />

It may be a admissible for Ta’zir punishment but I don’t agree it to be extended for Hadd. Another mind boggling factor is this. To my mind, this means that the Hadd for Zina is and will only be applicable when the moral value of the society is at its worst level and people start to fornicate in public without any shame or embarrassment. Even after attempts to stop the couple, they still continued fornicating in public.<o:p></o:p></span></div><div align="center" class="MsoNormal" style="text-align: center;"><span lang="EN-MY" style="color: #1f497d; mso-themecolor: text2;">I was told and I read as well that there has not been a single case of Hadd punishment for Zina on the basis of conviction. All of the previous convictions are based on confessions. I stand to be corrected as I do not have the any statistics to back this finding.<o:p></o:p></span></div><div align="center" class="MsoNormal" style="text-align: center;"><span lang="EN-MY" style="color: #1f497d; mso-themecolor: text2;">At the end of the day, Hadd is a punishment to free the sinner from punishment in the Hereafter which is way greater than in this world. One may be committing Zina in private and not be caught but that does not mean that Allah does not know what you are doing. If you think you can commit a sin in a place in this world where Allah would not know and cannot see you, by all means, go ahead and do it. And please tell me of this place as well because as far as I am concerned, nothing escapes Him. He knows what is apparent, hidden, before and after.<o:p></o:p></span></div><div align="center" class="MsoNormal" style="text-align: center;"><span lang="EN-MY" style="color: #1f497d; mso-themecolor: text2;">I think that this should prove that Hadd for Zina more of a preventive measure for others not to do it rather than deterrent punishment for those convicted. Well, it is a deterent factor if you are not married but if you are married, there is nothing to deter you from comitting the crime because dead people cannot commit crimes...<o:p></o:p></span></div><div align="center" class="MsoNormal" style="text-align: center;"><span lang="EN-MY" style="color: #1f497d; mso-themecolor: text2;">But we still need to have it as Hadd for Zina available to Muslims who fall under the first category where the adulterer wants to confess of his sin and get rid of the sin's burden from his shoulders by facing the punishment provided by Allah.<o:p></o:p></span></div><div align="center" class="MsoNormal" style="text-align: center;"><span lang="EN-MY" style="color: #1f497d; mso-themecolor: text2;">Be that as it may, if the burden of proving the couple does not reach the level of Hadd for Zina, the adulterer may still be punished under Ta’zir which is the discretionary powers of the Court.
